Vyom Cloud ("we", "us", "our") operates vyomcloud.com and provides VPS hosting, cloud hosting, and dedicated server services (the "Services"). This Privacy Policy explains how we collect, use, store, and protect your personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and applicable Indian law.
Placeholders to replace before publishing: company legal name, registered address, CIN (if applicable), DPO/contact email, grievance response timeline, and any third-party processors (payment gateway, CDN, email service) you actually use.
1. Personal Data We Collect
2. How We Collect Data
- Directly from you — signup forms, contact forms, support tickets, checkout
- Automatically — cookies, server logs, analytics tools
- From third parties — payment gateways, resellers (where applicable)
3. Legal Basis and Consent
We process your personal data only for the specified purpose you were informed of at the time of collection, and only with your clear, affirmative consent, except where processing is permitted without consent under the DPDPA (for example, to comply with law or for specified "legitimate uses" such as fulfilling a contract you've requested).
Consent requests are presented separately for each purpose (e.g., service delivery vs. marketing) — not bundled together.
You may withdraw consent at any time, as easily as you gave it, by emailing gaurav@bharatdatacenter.com or via your account settings.
Withdrawal does not affect the lawfulness of processing carried out before withdrawal, and may affect our ability to continue providing certain Services.
4. How We Use Your Data
- To provision and maintain your hosting/VPS/dedicated server account
- To process payments and generate invoices
- To respond to support requests
- To detect fraud, abuse, and security incidents
- To send service-related notices (mandatory) and marketing communications (only with consent)
- To comply with legal and regulatory obligations
5. Data Sharing and Cross-Border Transfer
We do not sell your personal data. We may share data with:
- Payment processors, for completing transactions
- Cloud/CDN infrastructure providers, where applicable [list providers and their hosting locations]
- Law enforcement or regulators, where legally required
Where personal data is transferred or stored outside India, we ensure such transfer is permitted under Section 16 of the DPDPA and is not to a country restricted by the Central Government.
6. Data Retention
We retain personal data only as long as necessary for the purpose it was collected, or as required by law (e.g., billing records under tax law). Once the purpose is served and no legal retention obligation applies, data is deleted or anonymized.
7. Your Rights
Under the DPDPA, you have the right to:
- Access a summary of the personal data we hold about you and the processing activities
- Correction and updating of inaccurate or incomplete data
- Erasure of your personal data, once it's no longer needed for the stated purpose
- Grievance redressal — raise a complaint about how your data is handled
- Nominate another individual to exercise these rights on your behalf in the event of death or incapacity
To exercise any of these rights, email connect@bharatdatacenter.com with the subject "Data Rights Request". We will respond within [X] business days.
8. Children's Data
Our Services are intended for use by individuals aged 18 and above. We do not knowingly collect personal data of children, and we do not process children's data for tracking, behavioral monitoring, or targeted advertising.
9. Data Security
We implement reasonable technical and organizational safeguards — encryption in transit, access controls, and monitoring — to protect your data against unauthorized access, alteration, disclosure, or destruction. In the event of a personal data breach, we will notify the Data Protection Board of India and affected users as required under Section 8(6) of the DPDPA.
